A standard IT networking agreement should be clear and accessible to comply with Section 22 of the CPA.

Service Level Agreements (SLAs):
- VXK Tech must explicitly define commitments regarding network quality, uptime, and performance.
- Remedies for failing to meet these levels, such as service credits, must be documented.

Limitation of Liability:
- Terms must include a "safe harbour" clause for ISPs under Chapter XI of the ECT Act, protecting the company from liability for data it merely transmits or routes.
- VXK Tech is generally not liable for losses caused by customer use that is contrary to law or fair practice.

Customer Responsibilities:
- Customers are liable for all acts of third parties using the network, including fraudulent use resulting from a breach of the customer's own LAN.
- Customers must not deliver damaging code (viruses) or attempt to breach VXK Tech's security measures.

Payment and Termination:
- Fees are typically payable monthly in advance.
- Standard cancellation notice for long-term contracts is often 90 days before the end of the initial period to avoid automatic renewal.
2. Key Legal Regulations
VXK Tech must operate within a strict legislative framework to avoid fines of up to R10 million or imprisonment.

POPIA (Data Protection):
- VXK Tech must appoint and register an Information Officer with the Information Regulator.
- The company must implement "appropriate and reasonable" technical measures (e.g., encryption, MFA, firewalls) to protect personal data.

ECT Act (Electronic Transactions):
- Provides legal recognition for electronic contracts and signatures.
- It criminalises "cyber-offences" like hacking and unauthorized data interference.

Cybercrimes Act of 2020:
- VXK Tech is obligated to report any cybercrime (e.g., hacking, extortion) detected on its network to the SAPS within 72 hours.

RICA:
- Requires telecommunication providers to obtain and verify specific information (identity, address) before providing services.

ICASA Licensing:
- Networking companies providing electronic communication services generally require a license from the Independent Communications Authority of South Africa (ICASA) unless specifically exempted.
3. Compliance Checklist for VXK Tech
- Appoint an Information Officer and register them with the Regulator.
- Conduct a Gap Analysis to identify vulnerabilities in current networking infrastructure.
- Draft a Privacy Policy that clearly outlines what data is collected and for what legitimate business purpose.
- Implement Technical Safeguards, including next-generation firewalls, multi-factor authentication (MFA), and endpoint protection.
- Review Third-Party Contracts to ensure vendors handling your data are also POPIA compliant.
